Cyclosporine - USA (March 28, 2018 Events)

As mentioned in earlier post, (click here to view earlier post) The Patent Trial and Appeal Board (The PTAB) of the United States Patent and Trademark Office (USPTO) denied to terminate IPRs related to Cyclosporine (Restasis®) filed by The Saint Regis Mohawk Tribe.

Key Events of March 28, 2018:

The Federal Circuit issued a stay of further The PTAB proceedings pending the Tribe’s sovereign immunity appeal. The appeal challenges the Board’s determination that the Tribe is not immune from its proceedings as a sovereign entity.

The Board cancelled the hearing scheduled for April 3rd. (click here to view order). The stay will be automatically lifted the day after the oral argument, scheduled for June. (Click here to view order)
